The administrative decision on the loss of the Polish citizenship is issued upon request of the individual concerned, of the party that proves its legal interest or of the party obliged to obtain such decision. In principle, the proceedings in such case are initiated upon request, but it may also be initiated ex officio.
The application for confirmation of Polish citizenship or loss of Polish citizenship should include the personal details of the applicant (the individual whom it concerns), of his or her antecedents up to 2nd degree as well as information on circumstances relevant for determining the legal status and factual background. The applicant, be it the person concerned or other party, is required to append the documents verifying the details included in the application unless obtaining these documents entails difficulties hard to overcome.
The application for confirmation of Polish citizenship or loss of Polish citizenship should be submitted to the voivode territorially competent with respect to the place of residence or the last place of residence in the territory of Poland of the individual whom the proceedings concern. In case the foregoing was impossible to determine, the application should be submitted to the voivode of the Mazowieckie Voivodeship.
An individual living outside the territory of Poland can submit the application for confirmation of Polish citizenship or loss of Polish citizenship through the agency of the consul territorially competent with respect to their place of residence. In this case the consul immediately passes the application on to the voivode together with attached documents and information about the individual whom the proceedings concern.
